The issue is whether § 577.023 authorizes enhancement if the prior offense was a guilty plea to a DWI in violation of a municipal ordinance with the imposition of sentence being suspended. The trial court answered no and dismissed an information filed against Mark A. Meggs (Defendant). The State appeals pursuant to § 547.200.2. We reverse and remand.
